Accrual of period to file 34 Appeal and Condonation of Delay if any
1 In computation of limitation, the prescribed period of three months to prefer an Appeal, does not include the extended period of 30 days; and benefit of S.4 of Limitation Act not available.
2 Section 5 of Limitation Act cannot be invoked to condone delay.
3 The starting point of Limitation in case of suo moto correction of Award, would be the date on which the corrected Award is received by the Party.
4 The period of Limitation would begin to run from the date of receipt of Award, notwithstanding Application u/s 33 may have been made and the same is pending.
5 The provision of Section 5 of the Limitation Act does not apply to the proceedings u/s 34 of the Act.
6 Section 5 of Limitation Act cannot be invoked to condone the delay in preferring S.34 Petition.
7 The period spent in litigating S.34 Petition before wrong Court can be condoned by virtue of S.14 of Limitation Act, 1963.
