Grounds on which the Award may be set aside
1 Grounds summarized: An Award contrary to (a) fundamental policy of Indian law; (b) the interest of India; (c) justice or morality; (d) patently illegal.
2 In order to succeed in challenge to an Arbitral Award, it must be shown that the Award suffers from perversity or an error of law that goes to the root of the matter.
3 A challenge, as to the jurisdiction of Arbitrator to award a particular claim, not involving question of fact, can be raised for the first time u/s 34.
4 An Award set aside on the grounds of Fraud, patent illegalities and is in conflict with the public policy of India.
5 The Rejection of Application u/s 34 of the Act cannot be construed to mean that Court have concurred with the view of Arb. Tribunal.
6 A Party is not precluded from raising additional grounds of challenge post the passing of Arbitral Award which was remanded u/s 34(4).
