Challenge before which Court
1 The Civil Court situated within the territorial jurisdiction of the seat or place of arbitration alone will entertain an application under Section 34 of the Act.
2 An Award has to be challenged before appropriate Court as provided u/s 2(1)(e) of the Arb. Act, notwithstanding the plea of absence of Arb. Agreement.
3 If parties have chosen to file an application before a particular Court then they cannot go on file other proceedings in other Courts and cause confusion in jurisdiction.
