Appealable Orders: Section 37
1 The discretionary jurisdiction, as exercised by the arbitrator, merits interference, under Section 37(2)(b), only where such exercise is palpably arbitrary or unconscionable.
2 What cannot be done u/s 34, cannot be done u/s 37 as well.
3 The Courts exercising powers u/s 37 must be circumspect in their approach to the Interim Orders passed by Arbitrator u/s 17.
4 A Party preferring Appeal u/s 37 of the Act, must first challenge the Award u/s 34 of the Act.
5 When it comes to the scope of an Appeal under Section 37 of the Arbitration Act, the jurisdiction of an Appellate Court is all the more circumscribed.
