The Courts where section 138 complaints are to be filed

Whether the dishonoured cheque was a bearer cheque or crossed cheque, the Courts at the Payee’s Bank would have the jurisdiction to entertain Complaints.

Section 138 proceedings can be transferred from one State to another, invoking section 406 of CrPC, 1973.

The Courts where the Payee maintains the Bank Account, shall have the jurisdiction to entertain section 138 complaints.

In Cases where it is alleged that the concerned Judicial Magistrate has no Jurisdiction, any such Application has to be filed before the same Magistrate.
