Jurisdiction of Courts: Sections 2(1)(e), 42, 9
1 The first Court where a party to an Arbitration Agreement files a Valid Application, is a Court of competent jurisdiction for All Arbitration related issues.
2 An Arbitration Agreement may provide that a Venue of Arbitration shall be at Place “X” and may provide that Courts at Place “Y” shall have the jurisdiction.
3 In Commercial Arbitration, the designated Commercial Courts shall have the jurisdiction to entertain Arbitration related Applications.
4 Unless agreed otherwise, Section 9 would apply to Foreign seated Arbitration and competent Indian Courts would have the jurisdiction to grant Interim Reliefs.
5 In a Commercial dispute valuing more than Rupees One Crore, the Commercial Courts would have the jurisdiction to entertain S.9 Applications.
6 Unless agreed otherwise, in foreign Seated Arbitrations, S.9 Application can be filed at any place where Assets of Respondents situate.
