Legal Principle - Actual language of the statute is not required in the Pleadings:
It may be observed here that though it may be apt yet it is not necessary for any petitioner who invokes the jurisdiction of the Special Court/ Special Tribunal to use in his petition under Sections 7(1) and 8(1) of the Act, the actual words employed in the relevant provisions of the Act. Prima facie it will satisfy the requirements of the Act if the petitioner alleges that the respondent is a land grabber or that he has grabbed the land. What is pertinent is that the allegations in the petition/plaint, in whatever language made, should make out the ingredients of land grabbing against such a person or his being a land grabber within the meaning of those expressions under the Act, as explained above.
